Spring Meeting 2019

In cooperation with the Montaigne Centre for Rule of Law and Administration of Justice (UU) and the Amsterdam Centre on the Legal Professions (UvA), the VWR will organise its annual spring meeting on the following topic:

Judicial independence in the interplay of constitutional principles.

The VWR spring meeting 2019 takes place June 6th, 2019 in Utrecht. On June 7th, 2019, there will be a panel discussion on the topic of judicial independence prior to the oratio of Prof Marc de Werd in Amsterdam.

At  the  VWR’s  annual  spring  meeting,  we  will  take  a  philosophical  perspective  to   discuss  about  the  position  of  the  judiciary  (here:  judges,  not  public  prosecutors)   in  liberal-­‐democratic  states.  This  philosophical  reflection  will  enable  us  to  find   points  of  reference  for  the  reassessment  and  possible  strengthening  of  the   judicial  position  in  changing  political  and  societal  contexts.  The  focus  of  the   conference  will  be  on  the  meaning  of  the  principle  of  judicial  independence  in  its   interplay  with  other  constitutional  principles,  such  as  democracy,  separation  of   powers,  and  protection  of  fundamental  rights.  Contributions  will address   different  levels  of  judicial  functioning,  for  example:  the  judiciary  as  an  institution   (role  in  the  constitutional  system),  organisation  (internal  dynamics,  inter  alia  the   role  of  judicial  councils),  and  the  community  of  legal  professionals  (professional   ethics).  Contributions  can  address  developments  in  specific  national  contexts   (including  the  Netherlands  and  Belgium)  or  transnational  developments  (in   particular  in  Europe).
